These Terms of Service ("Terms") govern your use of the GammaWins website, calculator, Calculator Pro subscriptions, and related services (collectively, the "Service").
The Service is provided by GammaWins AB (org. no. 559533-5067), a company registered in Sweden ("GammaWins", "we", "us", or "our").
By using the Service, creating an account, or subscribing to Calculator Pro, you agree to these Terms. If you do not agree, you must not use the Service.
Our Privacy Policy explains how we process personal data.
Eligibility
You must be at least 16 years old and legally able to enter into an agreement to use the Service. You are responsible for complying with the laws that apply to you.
Accounts
Some features require an account. You are responsible for keeping your login details secure and for activity carried out through your account. Please contact us promptly if you believe your account has been accessed without authorization.
You must provide accurate account information and must not impersonate another person or use multiple accounts, shared accounts, or other methods to bypass subscription restrictions or usage limits.
Subscriptions and Billing
GammaWins offers free features and paid Calculator Pro subscriptions. The features, billing period, price, and any applicable taxes are shown before you subscribe.
Subscriptions are billed in advance on a monthly or annual basis. Payments are processed by Stripe or another payment provider we designate.
By subscribing, you authorize us and our payment provider to charge your selected payment method for the subscription price, applicable taxes, and future renewals.
Your subscription automatically renews for the same billing period unless you cancel before the renewal date. You may cancel at any time through the available subscription management tools. Unless otherwise stated, cancellation takes effect at the end of the period you have already paid for.
If a payment fails, we may retry the payment and suspend access to paid features until payment is received.
We may change subscription prices for future billing periods. We will provide reasonable notice before a price increase applies to your renewal, giving you an opportunity to cancel.
Free Trials and Promotions
We may offer free trials, discounts, or other promotions. Eligibility and conditions may vary, and unless otherwise stated, each user is eligible for one free trial.
If a free trial requires a payment method, your subscription will automatically become paid when the trial ends unless you cancel beforehand. The price and billing period that will apply after the trial are shown before you subscribe.
We may refuse or revoke a trial or promotion if we reasonably believe it is being misused or obtained in violation of its conditions.
Refunds and Consumer Rights
Subscription payments are generally non-refundable, and cancellation does not normally provide a refund for the current billing period. This does not affect any refund, withdrawal, cancellation, or other rights you have under applicable law.
Consumers in the European Union generally have 14 days to withdraw from an online service contract. If you request immediate access to Calculator Pro during that period and later withdraw, we may deduct an amount proportionate to the service already provided where permitted by law.
Nothing in these Terms limits mandatory consumer rights, including legal remedies where a digital service is faulty, unavailable, or not provided as agreed.
Your Right to Use GammaWins
Subject to these Terms, GammaWins gives you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal, non-commercial use only.
You may not use the Service on behalf of any business, organization, investment adviser, fund, or other legal entity, or for any commercial or professional purpose, unless GammaWins has expressly authorized that use in a separate written agreement.
GammaWins and its licensors retain all rights in the Service, including its software, designs, branding, documentation, calculations, and original content. You may not copy, modify, redistribute, sell, sublicense, reverse engineer, or commercially exploit the Service except where permitted by law or expressly authorized by us.
Saved and Shared Content
You retain ownership of any content you create, save, or upload through the Service.
You give GammaWins permission to store, process, reproduce, and display that content only as reasonably necessary to provide, maintain, secure, and improve the Service.
Content shared through a public or shareable link may be accessible to anyone who receives that link. You are responsible for what you create, save, or share and must not submit content that is unlawful or infringes the rights of another person.
Although we take reasonable measures to protect saved content, you should not use GammaWins as the only copy of information that is important to you.
Acceptable Use
You must not:
- Use the Service for unlawful, fraudulent, or abusive purposes.
- Access another person's account or any non-public part of the Service without authorization.
- Interfere with the security, operation, or availability of the Service.
- Introduce malicious software, harmful code, or content intended to damage the Service or its users.
- Use automated methods to access or collect information from the Service unless we have authorized them.
- Circumvent subscription restrictions, access controls, technical limitations, or usage limits.
- Systematically copy, scrape, redistribute, or resell proprietary market data, calculations, or analytical outputs.
- Use systematic extraction or copying of the Service to create or operate a substantially similar competing product.
We may limit, suspend, or terminate access where we reasonably believe these rules have been violated.
No Financial or Investment Advice
GammaWins is an analytical tool provided for informational and educational purposes. It does not provide financial, investment, legal, tax, or other professional advice.
Nothing in the Service is a recommendation to buy, sell, or hold a financial instrument or to use a particular trading strategy. GammaWins is not an investment adviser, broker, dealer, or financial planner.
Calculations, charts, valuations, Greeks, probabilities, expected moves, profit and loss projections, and other outputs are estimates based on user inputs, third-party data, mathematical models, and assumptions. They may differ from actual market prices and outcomes and may not account for transaction costs, liquidity, slippage, taxes, assignment, exercise, dividends, or changing market conditions.
Historical data, historical performance, and backtests do not guarantee or predict future results.
You are responsible for independently evaluating and verifying information and for all investment and trading decisions you make.
Market Data
The Service relies on market data and other services supplied by third parties. Data may be delayed, unavailable, incomplete, or inaccurate. We do not guarantee its availability, timeliness, completeness, or accuracy.
Exchanges and data providers may restrict how their data can be displayed, stored, or redistributed. We may change supported markets, data availability, or related features when necessary to comply with those restrictions.
Service Availability and Changes
GammaWins is an evolving product. We may add, update, replace, or remove features, supported markets, subscription plans, or other parts of the Service.
We aim to keep the Service reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, technical problems, third-party outages, legal requirements, or circumstances outside our control may affect the Service.
Where reasonably practicable, we will provide notice before discontinuing the Service or making a material change that significantly reduces a paid subscription during an active billing period.
Warranties and Liability
To the fullest extent permitted by law, the Service is provided "as is" and "as available". We do not guarantee that the Service, its calculations, data, or outputs will always be accurate, complete, timely, secure, or suitable for your particular circumstances.
To the fullest extent permitted by law, GammaWins is not responsible for trading losses, lost profits, loss of data, business interruption, or other indirect or consequential losses resulting from your use of or inability to use the Service.
To the fullest extent permitted by law, GammaWins' total liability arising from the Service will not exceed the amount you paid to GammaWins during the 12 months before the event giving rise to the claim.
These limitations do not apply where liability cannot legally be excluded or limited, including liability for fraud, intentional misconduct, gross negligence, or mandatory consumer rights.
Suspension and Termination
You may stop using the Service at any time. If you have a paid subscription, you must cancel it to prevent future renewals. Cancelling a paid subscription stops future renewals but does not entitle you to a refund for the current billing period except where required by applicable law or where we choose to provide one.
We may suspend or terminate your access if we reasonably believe you have violated these Terms, applicable law, or the rights of others, or if your use presents a security or operational risk. Unless required by applicable law, suspension or termination of your account does not entitle you to a refund.
We may also discontinue all or part of the Service for operational, legal, or business reasons. Where reasonably practicable, we will provide notice of a material discontinuation.
After an account is terminated, we may delete or anonymize account data and saved content in accordance with our Privacy Policy and applicable legal obligations.
Changes to These Terms
We may update these Terms when the Service, our business, or applicable requirements change. If a change is material, we will provide reasonable notice through the Service, by email, or by another appropriate method.
Updated Terms apply from the stated effective date. If you do not agree to an update, you should stop using the Service and cancel any active subscription before its next renewal.
Governing Law and Disputes
These Terms are governed by Swedish law. Disputes will be handled by the Swedish courts unless applicable law gives you the right to bring a claim elsewhere.
If you are a consumer, these Terms do not deprive you of mandatory protections available under the laws of your country of residence.
Consumers residing in Sweden may submit eligible disputes to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN). Information is available at www.arn.se.
General
If any part of these Terms is found invalid or unenforceable, the remaining parts will continue to apply.
If we do not enforce a provision immediately, that does not prevent us from enforcing it later.
